Terms of Service

1. Who We Are and What These Terms Cover

These Terms of Service ("Terms") are an agreement between you and Date Dish Inc., doing business as DateDish ("DateDish," "we," "us," "our"). They apply to the DateDish mobile application, the website datedish.com, and related features and services (together, the "Service"). If you do not agree to these Terms, do not use the Service.

2. Eligibility (18+ Only)

You must be at least 18 years old to create an account or use the Service. By using DateDish, you confirm that:

• you are 18 or older and able to enter into a binding contract;
• you are not prohibited from using the Service under any applicable law;
• you have not been convicted of, or required to register as a sex offender for, any sex crime or violent crime; and
• you have not previously been removed from DateDish, unless we have given you written permission to return.

If we learn that someone under 18 has created an account, we will delete it. If you believe a minor is using DateDish, please tell us at support@datedish.com.

3. Your Account

• You must give accurate, current information, including your own real photos. You may have only one account.
• DateDish requires a selfie before you can message other members, and that selfie may be shown to the members you interact with. It must be a real, current photo of you.
• You are responsible for keeping your login and verification codes private and for everything that happens under your account. Tell us right away at support@datedish.com if you think your account has been accessed without permission.
• You may not sell, transfer, or share your account, or create an account for anyone else.

4. Phone Verification and Phone Number Features

DateDish uses your phone number to verify your account and protect members from fake and duplicate profiles. We work with third-party providers, such as Trestle, to send one-time codes and check phone numbers, as described in our Privacy Policy.

Some features let you find or invite someone by phone number, for example inviting a friend or a Wingman. You may only enter a phone number that belongs to you, or one whose owner has agreed to be contacted or looked up for that purpose. You may not use any DateDish feature to locate, track, identify, or contact a person who does not want to hear from you, or to build a profile of a person who is not a DateDish member.

By giving us a phone number, you agree to receive text messages related to the Service, such as verification codes and invitations you choose to send. Message and data rates may apply. Reply STOP to opt out of non-essential messages, or HELP for help.

5. Trust Score, Trust Badges, Dishes, and Wingman Validation

DateDish offers trust and transparency features, including the Trust Score™, Trust Badges, Wingman Validation™, and the Dish™, a post-date reflection between the two people who went on the date. Please understand what these features are, and what they are not:

• They are signals, not guarantees. A Trust Score, badge, verification, Wingman validation, or Dish reflects information available to DateDish and input from members. None of them is a background check, criminal-records check, or promise that a person is safe, honest, or who they say they are.
• Be truthful and fair. Dishes, badges, and any other feedback you give must reflect your own honest, firsthand experience. You may not post false statements of fact, harassment, threats, hate speech, sexually explicit content, or another person's private information (such as a home address, workplace, or financial or medical details).
• No manipulation. You may not trade, buy, coordinate, or fake Dishes, badges, Wingman validations, or invitations, or use extra accounts or other people to raise your own score or lower someone else's.
• Who sees a Dish. Dishes are shared with the people involved and are not posted publicly or made searchable, as described in the app and our Privacy Policy. Whether you share your own Dish beyond that is your choice.
• Our discretion. We may change how these features work and how scores are calculated, and we may adjust, hide, or remove scores, badges, or Dishes that we believe are inaccurate, abusive, or against these Terms.

6. Community Rules

To keep DateDish safe and respectful, you agree that you will not:

• impersonate anyone, misrepresent your identity, age, or relationship status, or use photos that are not of you;
• upload AI-generated, synthetic, or deepfake images or videos of yourself or anyone else;
• harass, bully, stalk, intimidate, threaten, or defame anyone, on or off the Service;
• post or send nudity, sexually explicit material, or violent or hateful content, or any content involving a minor;
• solicit money, run scams, promote commercial services, or engage in sex work or trafficking;
• share another person's private information, or anything they shared with you privately, without their permission;
• use bots, scrapers, or other automated means to access the Service or collect information about members; or
• attempt to hack, disrupt, reverse engineer, or get around any security or verification feature of the Service.

We may remove content and suspend or terminate accounts that break these rules, and we may report illegal activity to law enforcement.

7. Your Safety and Meeting in Person

DateDish is a tool to help you make more informed choices. It does not screen members' criminal backgrounds, and we are not responsible for the conduct of any member, on or off the Service. You are solely responsible for your interactions with other people. Always use your own judgment: meet in public, tell a friend where you are going, arrange your own transportation, and read our first date safety checklist. If you are in immediate danger, call 911. To report a member, use the in-app reporting tools or email support@datedish.com.

8. Your Content

You own the photos, messages, Dishes, stories, and other content you submit ("Your Content"). By submitting Your Content, you give DateDish a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process it as needed to operate, improve, and promote the Service, consistent with your settings and our Privacy Policy. This license ends when you delete Your Content or your account, except where content has been shared with other members, for backups for a limited period, or where we must keep it for safety or legal reasons.

You are responsible for Your Content and confirm that you have the right to share it. We may review, moderate, or remove any content at our discretion, but we are not required to monitor all content.

9. Purchases and Subscriptions

Some features may require payment. Purchases are processed through Apple's App Store or Google Play and are subject to their terms. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription. Except where required by law or the store's own policies, payments are non-refundable; refund requests go through Apple or Google.

10. Our Intellectual Property

The Service, including its software, design, logos, and the DateDish®, Trust Score™, Dish™, and Wingman Validation™ names, belongs to Date Dish Inc. and is protected by intellectual property laws. We give you a personal, limited, non-transferable, revocable license to use the Service for its intended purpose under these Terms. You may not copy, modify, distribute, or create works based on the Service or our brand without our written permission.

11. Copyright Complaints

If you believe content on DateDish infringes your copyright, email support@datedish.com with: a description of the copyrighted work; where the content appears on the Service; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature.

12. Ending Your Use of DateDish

You may stop using DateDish and delete your account at any time from the app or by following the steps on our account deletion page. We may suspend or terminate your account at any time if we believe you have broken these Terms, created risk for other members or for DateDish, or if we stop offering the Service. Sections that by their nature should survive termination (including Sections 8, 10, and 13 through 17) will continue to apply.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, DATEDISH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY MEMBER, PROFILE, VERIFICATION, TRUST SCORE, BADGE, OR DISH IS ACCURATE, COMPLETE, OR RELIABLE. DATEDISH DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS. Dating safety guides on our website are general information only and are not legal, medical, or professional advice.

14. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, DATEDISH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so some of them may not apply to you.

15. Indemnity

You agree to defend and hold harmless Date Dish Inc. and its officers, directors, and employees from any claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your interactions with other members, or your breach of these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at support@datedish.com and give us 30 days to try to resolve the issue informally. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Virginia, and you and DateDish consent to their jurisdiction, except that either party may bring an individual claim in small claims court where it qualifies.

17. App Store and Google Play Terms

If you downloaded DateDish from Apple's App Store, you also agree that: these Terms are between you and Date Dish Inc. only, not Apple; Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any applicable warranty, you may notify Apple for a refund of any purchase price, and Apple has no other warranty obligation; Apple is not responsible for any product claims, intellectual property claims, or other claims relating to the app; you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Standard End User License Agreement also applies to the extent it does not conflict with these Terms. If you downloaded DateDish from Google Play, Google Play's terms also apply to your download and purchases.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will let you know through the app or by email before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms.

19. General

These Terms, together with our Privacy Policy and any additional terms shown to you in the app, are the entire agreement between you and DateDish about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets.
